Terms of Service
Effective date: November 5, 2026
Welcome to SweepTakers. These Terms of Service ("Terms") are a contract between you and Evolve Group LLC, a New York limited liability company ("SweepTakers", "we", "us" or "our"). They cover your use of our website at https://sweeptakers.com, the member dashboard, the SweepTakers Chrome extension, our emails, and everything else we offer under the SweepTakers name (together, the "Service").
Please read Section 17 (Dispute resolution) carefully. Unless you opt out within 30 days, it requires you and us to resolve most disputes through individual arbitration instead of in court, and it waives class actions and jury trials. You can still bring a claim in small-claims court.
1. Agreeing to these Terms
You accept these Terms when you create an account and tick the box agreeing to them, or when you otherwise use the Service. If you don't agree, don't use the Service.
These policies are part of these Terms and apply to you as well:
- Privacy Policy, which explains how we handle personal information
- Acceptable Use Policy
- Subscription, Auto-Renewal & Refund Terms (the "Subscription Terms"), if you subscribe to Pro
- Free Pro Rewards Program Terms (the "Rewards Terms")
- Sweepstakes & Affiliation Disclaimer
- Chrome Extension Privacy & Data Disclosure
- Copyright & DMCA Policy
If one of those policies conflicts with these Terms, the policy wins for its own subject (for example, the Subscription Terms control billing questions). Otherwise these Terms control.
2. Who can use the Service
To create an account or use the Service, you must:
- be at least 18 years old and have reached the age of majority where you live, if that is older than 18;
- be a legal resident of the United States, living in the United States;
- be able to form a binding contract and not be barred from using the Service under any law; and
- not have had a SweepTakers account suspended or terminated by us, unless we have agreed in writing that you may return.
The Service is not directed to children, and we do not knowingly allow anyone under 18 to use it. If we learn that a member is under 18, we will close the account and delete it, keeping only the records our Privacy Policy describes.
3. Your account
One person, one account. Each account is for one individual. You may not create or use more than one account, share your account, or let anyone else use it. Each member of a household who wants to use the Service needs their own account.
Accurate information. Keep your account details accurate and current. Your autofill profile must contain only your own true information. Never save another person's details in it.
Keep it secure. You are responsible for keeping your password secret and for activity under your account. Tell us right away at support@evolve-group-llc.com if you think someone else has accessed it. We may ask you to confirm that you control the account's email address before we act on a request.
Records of your agreement. When you sign up we record which version of these Terms you accepted, when you accepted them, and when you confirmed you are 18 or older. If we materially change these Terms, we may ask you to accept the new version before you continue.
4. What the Service is, and what it is not
The Service is a software tool. It has four parts:
- Sweepstakes feed. A list of sweepstakes and giveaways gathered from sources that license or permit our use, from submissions by members, and from our own team's research. Listings contain basic facts and links to the sponsor's official pages.
- Entry tracker. A record of the sweepstakes you entered, so you can see what you entered, when, and when you may be allowed to enter again.
- Copy-assist. An entry page on our website that opens the sponsor's official entry page and lets you copy your saved details one field at a time while you fill in the sponsor's form yourself.
- Autofill assistant (Pro). A feature of the Chrome extension that fills your saved details into the entry form on the sponsor's own page when you ask it to. It works only while you have accepted the current version of these Terms and confirmed that you are 18 or older. You review every field and click the sponsor's own Submit button yourself.
SweepTakers fills in the blanks — you do the entering. We never submit entries for you, solve CAPTCHAs, or enter on your behalf. The autofill assistant never clicks Submit or Next buttons, never presses Enter, and never touches CAPTCHAs, password, payment, file-upload or one-time-code fields. You must complete those yourself.
The "I agree" button. The autofill assistant never ticks a checkbox on its own. After it fills a form, it may offer a button such as "Check all required boxes (I agree)". It first lists what each box it would tick says (it shortens very long text, so read the boxes on the form as well), and it ticks only the boxes it lists, and only when you click the button. It is built to list only boxes on that form that the form marks as required and that accept the sponsor's Official Rules, terms or privacy policy, or confirm that you are eligible (for example, that you are a legal resident) or old enough, and to tick an age box only when the date of birth saved in your profile shows that you are at least that age. It is built to leave marketing, newsletter, promotional and text-message boxes, consent to be contacted or to have your information shared, any other opt-in, and any box it isn't sure about. But it can't read every form correctly: it may list a box that also signs you up for something, or miss an age a box asks about (for example when the age is written in a way it doesn't recognize or, for a box such as "I am eligible to enter", is stated only at the top of the form or in the Official Rules) and tick that box without checking your date of birth. Your click is your own agreement to the sponsor's Official Rules and your own confirmation of every statement in those boxes, just as if you had ticked each box yourself, and you are responsible for it. Before you click, read the Official Rules and check each listed box and the rest of the form, and don't click if any of them is not true for you or you don't agree. Some pages tick other boxes themselves when a box is ticked. Before you submit, untick anything you don't agree to: what you submit is your decision. The button never solves CAPTCHAs and never submits: you decide on the other boxes, complete any verification and click the sponsor's own Submit button yourself.
We are not a sweepstakes. SweepTakers is an independent service. We do not sponsor, administer, or judge any sweepstakes, contest, or giveaway listed in the Service, and we are not affiliated with, endorsed by, or acting for any sponsor, promoter, or listing website unless we expressly say so. Each sweepstakes is run by its sponsor and governed solely by its sponsor's Official Rules. No purchase is necessary to enter any sweepstakes, and a SweepTakers subscription does not affect your eligibility or improve your odds of winning.
Paid placements ("Sponsored Ad"). Sponsors may pay us to feature their own sweepstakes in the Service for a period of time. We label each paid placement "Sponsored Ad". The same sweepstakes may also appear among our other listings without the label, in the place it would have anyway. A paid placement appears only while its listing shows "Reviewed by SweepTakers", which it earns through the same review as any other listing. Payment does not affect our review, whether a listing shows that label, or the order of the other listings. We do not endorse the sponsors who pay for placements or their promotions, and a paid placement does not make us the promotion's sponsor or administrator. The sponsor's Official Rules govern the promotion.
No guarantees about entries. We do not guarantee that you are eligible for any sweepstakes, that a listing is accurate, current or legitimate, that any entry will be accepted or valid, or that you will win anything. Sponsors decide whether entries are valid, and their decisions are between you and them.
Autofill may be unavailable. We turn autofill off for sweepstakes whose Official Rules we know require manual typing or prohibit form-fillers, and for websites whose owners have asked us to. Autofill may also fail to recognize some forms or fill some fields incorrectly. Always check every field before you submit.
5. Official Rules are your responsibility
Every sweepstakes has Official Rules set by its sponsor. Before you enter, you must read and follow them, including their rules on eligibility (age, residence and other conditions), entry limits and entry frequency, entry methods, and any restriction on how entries may be made.
Do not use the autofill assistant on any sweepstakes whose Official Rules:
- require entries to be typed manually or "manually key-stroked" by the entrant, or
- forbid form-fillers, autofill or form-filling software by name.
General clauses against automated entry, entry services and AI. Many Official Rules also void entries made by bots or scripts, or by "robotic, automatic, macro, programmed, third-party or like methods", and some ban "sweepstakes entry services" or "any use of artificial intelligence (AI)" by name. We read a general clause like that as aimed at entries made by software instead of by the entrant, and not at a tool you run yourself to fill in your own details on the sponsor's page, in your own browser, while you review the form and click Submit yourself. We read a ban on entry services as aimed at companies that enter sweepstakes for you in bulk, by mailing entries or submitting them automatically. SweepTakers isn't one of them: it's productivity software that fills in your details, and you start the fill yourself, review it and submit your own entry. We read a ban on artificial intelligence (AI) as aimed at entries that AI makes or submits. For filling forms, SweepTakers uses AI only to draft and check the form templates we use for some sweepstakes ahead of time and, during a fill, to recognize fields it can't match on its own. For those fields it sends AI the website's domain name and how the page describes them (such as their labels), never your saved profile or what's in the form's fields, and it first removes the saved details that could identify you, such as your name, email, phone number and address, where it finds them in that description. AI never enters for you or clicks Submit. So we keep autofill on for those sweepstakes. That is how we read these clauses, not a promise about how a sponsor will read them: the sponsor decides whether an entry is valid. If you read a sweepstakes' rules as forbidding the autofill assistant, or the sponsor tells you so, don't use it there; enter by hand. Our reading covers filling in your details, not the "I agree" button in Section 4. On those sweepstakes, tick the boxes yourself if you're not sure the rules allow the button.
You are solely responsible for complying with each sweepstakes' Official Rules and with any terms of the website where you enter. If a sponsor disqualifies an entry or an entrant, voids a prize, or takes any other action, that is between you and the sponsor. We are not responsible for it. The entry tracker's reminders about entry frequency are a convenience only and may be incomplete; the Official Rules always control.
6. Plans, Pro and billing
Free plan. Browsing the feed, saving favorites, the entry tracker, copy-assist, and submitting giveaways are free.
Pro. Pro adds the autofill assistant and related features. Pro costs $10.00 per month, plus applicable sales tax, and renews automatically every month until you cancel. You can cancel anytime online in Dashboard > Billing > Cancel subscription. When you cancel, Pro stays active until the end of the period you have paid for. Price, renewal, cancellation, refund, failed-payment and price-change terms are set out in full in the Subscription Terms, which are part of these Terms.
Free Pro time. New accounts receive 30 days of Pro without entering a payment card, and members can earn free months of Pro under the Rewards Terms (for most paying members, as a credit toward their next charge). Free Pro time never turns into a paid subscription. You are only charged if you separately subscribe and agree to be charged at checkout.
Payments. Payments are processed by Stripe, Inc. ("Stripe"). By subscribing you also agree to Stripe's terms that apply to you as a payer. We never receive or store your full card number.
7. Acceptable use
You must follow our Acceptable Use Policy. In particular, you may not:
- use bots, scripts, macros, auto-clickers, or any other automation to submit entries or to click, press or tap anything on a sponsor's page, whether alone or together with the Service (the autofill assistant's own "I agree" button, used as Section 4 describes, is not such automation);
- modify, wrap, or extend the Service or the extension so that it submits entries or acts without your direct, personal involvement;
- solve, bypass, or get around any CAPTCHA, verification step, rate limit, or anti-fraud measure, or use a service that does;
- create or use more than one account, or use more than one identity, name, email address, or mailing address to enter the same sweepstakes;
- enter sweepstakes on behalf of anyone else, or use another person's personal information;
- exceed any sweepstakes' entry limits or enter more often than its Official Rules allow;
- give false or misleading information to us or to any sponsor;
- scrape, crawl, copy, or harvest the Service or its listings by automated means, or use them to build a competing product or dataset;
- reverse engineer, decompile, or try to extract the source code of the Service, except to the extent applicable law expressly allows despite this restriction;
- resell, rent, or commercially exploit the Service or access to it;
- interfere with, overload, or probe the security of the Service; or
- use the Service to break any law or anyone else's rights or terms.
8. Your content and submissions
What counts as your content. "Your Content" means anything you send us through the Service, including giveaway submissions (sweepstakes listings you suggest), notes, and feedback. Your autofill profile and entry history are personal data, not Your Content; they are covered by the Privacy Policy.
License to us. You keep any rights you have in Your Content. You grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable and sublicensable license to use, copy, store, modify, adapt, publish, display, and distribute Your Content to operate, provide, improve, and promote the Service. "Sublicensable" means we may let our service providers do these things for us. Approved listings may stay in the Service after you close your account, but they will no longer be connected to you.
Your promises about Your Content. When you send us Your Content, you promise that:
- it is accurate, and any listing describes a real, currently open sweepstakes, taken from the sponsor's own official pages;
- you have the right to share it, and it does not copy anyone else's descriptions, editorial text, images, or other protected content;
- it contains no personal information about you or anyone else; and
- it contains no referral, affiliate, or tracking links, and is not spam, a scam, or a lead-generation scheme.
Moderation. We review submissions and may approve, edit, reject, or remove any of Your Content at our discretion. We have no obligation to publish anything. Free Pro time for approved submissions is governed by the Rewards Terms.
Sponsor connections. If you work for, represent, or are paid by a sponsor, its agency, or the company that runs a promotion for it, say so when you submit that sponsor's promotion. Connected submissions may be listed but do not earn rewards.
Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.
Content from others. Listings may come from other members or third-party sources. We do not guarantee their accuracy and are not responsible for them, but we may remove anything that breaks our policies.
Listing reviews. Some listings show "Reviewed by SweepTakers" and a date. It means someone on our team checked the items listed with that label against the sponsor's public pages on that date. A review covers only those items and only what the pages showed at the time. It is not an audit or investigation of the sponsor, not an endorsement, and not a promise that the sponsor will run the promotion fairly or award any prize. Sponsors can change their pages after we review them. Listings without the label, including listings from our feed partners, may not have been individually reviewed. The sponsor's Official Rules always control. We may review again, change, or remove any listing at any time, but we are not obliged to monitor listings.
9. Third-party websites and services
The Service links to and works on websites we do not control, including sponsors' entry and Official Rules pages, giveaway platforms, and listing websites. Their own terms and privacy policies apply when you use them.
When you click Submit on a sponsor's form, your entry information goes from your browser directly to the sponsor or its platform. We do not send it, and the sponsor's privacy policy governs how they use it.
We are not responsible for third-party websites, their content, their prizes, or their handling of your information.
10. Our intellectual property and your license to use the Service
The Service, including its software, the extension, design, text, graphics, and the SweepTakers name and logo, is owned by us or our licensors and protected by intellectual property laws. Sponsor names and trademarks shown in listings belong to their owners and are used only to identify the promotions.
Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service, and to install and use the extension on browsers you control, for your own personal, non-commercial use. All rights not expressly granted are reserved. You may not use our name or logo without our written permission.
To report copyright infringement, follow our Copyright & DMCA Policy.
11. Changes to the Service
We are constantly improving the Service, so features may change, be added, or be removed. We may also turn off autofill for particular sweepstakes or websites at any time, for example when a sponsor objects or when Official Rules prohibit form-fillers.
If we decide to stop offering Pro, or the Service as a whole, we will give you at least 30 days' notice by email and stop all future charges.
12. Suspension and termination
By you. You may stop using the Service at any time. You can cancel Pro in Dashboard > Billing, and you can permanently delete your account in Dashboard > Account. Deleting your account cancels any subscription immediately, so if you want to keep using Pro until the end of the period you have paid for, cancel first and delete your account later.
By us. We may suspend or terminate your account, remove Your Content, or reverse free Pro rewards if we reasonably believe that you have broken these Terms or our policies, committed fraud or abused the Rewards Program, created a risk or legal exposure for us, other members, or sponsors, or if the law requires it. Where it is appropriate and lawful, we will tell you why and give you a chance to respond.
What happens next. When we close an account, we delete it the same way as when you delete it yourself in Dashboard > Account: any subscription is canceled so that no further charges are made, and Pro access ends. If we close your account because you broke these Terms, you will not receive a refund, except where the law requires one. We delete account data as described in the Privacy Policy. Sections 5, 8, 10 and 12 through 20 continue to apply after your account is closed.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the paragraph above, we do not promise that:
- listings are accurate, complete, current, legitimate, or still open;
- you are eligible for any sweepstakes, or that any entry will be accepted, counted, or valid;
- you will win any prize;
- the autofill assistant will work on any particular website or form, or will fill every field correctly; or
- the Service will be uninterrupted, secure, or error-free.
You are responsible for checking every field before you submit an entry. Nothing in this section limits any warranty or right that applicable law does not allow us to exclude.
14. Limitation of liability
To the fullest extent permitted by law:
- No indirect damages. Neither we nor our officers, employees, or service providers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost or rejected entries, disqualification by a sponsor, or prizes you did not win, arising out of or relating to the Service or these Terms, even if we were told such damages were possible.
- Cap. Our total liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us in the 12 months before the event that gave rise to the claim, or (b) US $100.
These limits do not apply to liability for our fraud, gross negligence, or willful misconduct, to liability for death or personal injury caused by our negligence, or to any other liability that cannot be limited or excluded under the law that applies to you.
15. Indemnity
If a third party (for example, a sweepstakes sponsor) brings a claim against us that arises from (a) your breach of a sweepstakes' Official Rules or a third-party website's terms, (b) Your Content, or (c) your violation of these Terms or of law, you agree to defend us against that claim and to pay any damages, reasonable attorneys' fees, and costs finally awarded or agreed in settlement. This does not apply to the extent the claim results from our own breach of these Terms, negligence, or misconduct. We will tell you promptly about any such claim, we may control the defense, and you agree to cooperate reasonably.
16. Governing law
The Federal Arbitration Act governs Section 17. Otherwise, these Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. This choice of law does not take away any protection you have under the consumer protection laws of the state where you live that cannot be waived by contract.
17. Dispute resolution: informal resolution, arbitration and class-action waiver
17.1 Talk to us first
Most concerns can be solved quickly by emailing support@evolve-group-llc.com. Before starting an arbitration or a small-claims case, you and we each agree to send the other a written notice describing the dispute and the relief requested, and to try in good faith to resolve it for at least 30 days. Send notices to us by email at support@evolve-group-llc.com, including your name, the email address on your account, a description of the dispute, and what you want. We will send notices to the email address on your account. Any deadline for bringing a claim is paused while this process runs.
17.2 Agreement to arbitrate
Except as described in Section 17.3, you and we agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms, including their formation, interpretation, or enforceability, will be resolved by binding individual arbitration, not in court. The arbitrator decides all questions about the scope, validity, and enforceability of this Section 17, except that a court decides questions about Sections 17.5 (class-action waiver) and 17.7 (mass arbitration).
17.3 Exceptions
Either you or we may (a) bring an individual claim in small-claims court in the county where you live, or in Albany County, New York, if it qualifies; and (b) bring an individual action in court to stop infringement or misuse of intellectual property rights.
17.4 How arbitration works
The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect when the claim is filed (available at adr.org), as modified by this Section 17. A single arbitrator will decide the dispute. Hearings may be held by video or telephone, or the arbitrator may decide on written submissions. Unless you and we agree otherwise, any in-person hearing will take place in the county where you live or in Albany County, New York, at your choice. The arbitrator may award any individual relief that a court could award to you individually under applicable law, and must give a written decision. Fees: we will pay all AAA filing, administrative, and arbitrator fees for an arbitration you start, unless the arbitrator finds that your claim was frivolous or brought for an improper purpose. Each side pays its own attorneys' fees unless the law or the arbitrator's award provides otherwise.
17.5 Class-action and jury waiver
You and we may bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not combine more than one person's claims (except as described in Section 17.7) and may not preside over any class or representative proceeding. You and we each waive the right to a jury trial. If a court finally decides that this Section 17.5 cannot be enforced for a particular claim or remedy, then that claim or remedy (and only it) will be decided in court, after any individual claims are arbitrated, and it may not be arbitrated on a class basis.
17.6 Public injunctive relief
Nothing in this Section 17 prevents you from seeking public injunctive relief where applicable law gives you a non-waivable right to do so. Any such request will be decided by a court after the arbitration of all individual claims, and the court proceeding will be paused until then.
17.7 Mass arbitration
If 25 or more demands for arbitration that raise similar claims are filed by or with the help of the same or coordinated lawyers or organizations, the AAA's Mass Arbitration Supplementary Rules will apply, together with this paragraph. The demands will be administered in batches of up to 50, with one arbitrator assigned to each batch and one set of fees per batch. Each claimant in a batch keeps the right to present their own claim and to receive an individual decision, and no decision binds any claimant who was not a party to it. Any deadline for bringing a claim is paused for each claimant whose demand is waiting to be administered. If the AAA's rules or this paragraph cannot be applied, the demands will proceed individually.
17.8 Your right to opt out
You may opt out of this agreement to arbitrate by emailing support@evolve-group-llc.com within 30 days after you first accept these Terms. Include your name, the email address on your account, and a clear statement that you want to opt out of arbitration. Opting out does not affect any other part of these Terms, and it does not affect any arbitration agreement you had with us before.
17.9 Changes to this section
If we change this Section 17, we will give you at least 30 days' notice, and the change will not apply to any claim that was already filed or noticed. If you do not agree with the change, you may reject it by emailing support@evolve-group-llc.com within those 30 days, in which case the previous version of this Section 17 continues to apply to you.
17.10 Court venue
If a dispute is decided in court rather than in arbitration (for example, because you opted out), it will be decided by the state or federal courts located in Albany County, New York, unless the law of the state where you live gives you the right to sue in your home county. You and we consent to those courts' personal jurisdiction.
18. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will tell you at least 30 days before it takes effect, by email or with a notice in the Service, and we may ask you to accept the new Terms before you continue using your account. Changes do not apply retroactively. Changes needed to comply with the law, or that only concern new features, may take effect immediately. If you do not agree to a change, stop using the Service and delete your account before the change takes effect. Changes to subscription prices follow the notice rules in the Subscription Terms.
19. General terms
- Entire agreement. These Terms and the policies listed in Section 1 are the entire agreement between you and us about the Service.
- Electronic communications. You agree that we may give you notices, disclosures, and agreements electronically, by email to your account address or in the Service, and that these satisfy any legal requirement that they be in writing.
- Assignment. You may not transfer these Terms. We may transfer them in connection with a merger, acquisition, or sale of assets, or by operation of law, and we will tell you if we do.
- Severability. If any provision of these Terms is found unenforceable, the rest stays in effect, except as stated in Section 17.5.
- No waiver. Not enforcing a provision is not a waiver of our right to enforce it later.
- Events beyond our control. We are not liable for delays or failures caused by events outside our reasonable control.
- California residents. Under California Civil Code Section 1789.3, California users are entitled to this notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs can be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
